Terms and conditions: Welcome

Fees and commission (FOR ACTS ONLY)
NETT FEES HOLD NO COMMISSION
Fees and commission are variable with each different employment gained through SWPA. The client agrees to pay SWPA on a weekly basis from the commencement of their contracted pay day. Earnings under £200.00 are liable for a 5% commission to the Agency. Earnings between and £200.01p and £300.00 are Liable for a 7.5% commission to the Agency. Earnings of £300.01 and above are liable for a 10% commission payable to the Agency. All commission must be paid within 7 days of first pay date(static/seasonal) Any other payments must be paid within 7 days after performance (CABARET BOOKER/VENUE) or by date given on invoice. All CLIENTS/ACTS/ARTISTS are responsible for their own tax, national insurance or government payments from the country the reside or work. It is not the responsibility of the agency or any of its affiliates.

Cabaret / tribute acts bookings
All ACTS are booked through the agency and are responsible for their own tax, national insurance or government payment from the country they reside or work, it is not the responsibility of the agency or any of its affiliates. 
The Agency work as a middleman for both the ACT and BOOKER/VENUE. All details of the engagement will be verbally agreed before committing them the signed contract. If either party is unhappy with anything in the contract they must NOT sign until all details are agreed upon by both ACT and BOOKER/VENUE.
All fees will be decided before the contracts are signed.
All payments from the BOOKER/VENUE will be made directly to the agency via an invoice from SWPA, and the ACT will subsequently be paid into the account of their choice once a valid invoice has been received. 
Invoices sent by the ACT must be the total with the 10% commission payable to the AGENCY deducted. (if requested it can be made as a separate payment from the ACT but must be paid within 7days of receiving fee payment). 
All payments from BOOKER/VENUE must be made within 7 days after the performance. Failure to do so will incur a 10% increase of the initial fee.
(ACTS) If the artist is paid on a cash basis, they have 7 days to pay the appropriate commission to the agency. An invoice from the agency will be sent to the artist.

The ACT or VENUE may not seek work or hire independently with a previously contracted ACT or VENUE via SWPA for 1 year from the completion of contract unless using the agency to regain employment with them. If a contract is terminated before its commencement, by either the ACT/BOOKER/VENUE or SWPA, SWPA are not liable for any money to the art ACT or VENUE, that would have been earnt during it's running.
All ACTS are representing the quality of the agency and therefore must present themselves to a high standard at all times.
It is the duty of the BOOKER/VENUE to ensure working conditions are safe and secure and suitable changing facilities must be provided where available. Its is not the responsibility of SWPA. Although we will do a preliminary check with each contracting company to ensure professional working condition as best, we can. 

Static/Seasonal Employment
 All employment gained via SWPA must be notified directly to the office upon confirmation of employment. Failure to do so may result in legal proceedings and a lawsuit. Any contracted employment gained Via the Agency must be completed to the end. If a contract is terminated prematurely in the event of unavoidable situations I.E Health, Loss of loved ones or personal grievances with contracted employer the office must be notified immediately and SWPA will not be financially liable for any loss of earnings. If a contract is terminated prematurely due to misconduct by the employee, then the employee will still be liable for commission owed to the end of your contract.  The employee may not seek work independently with a previously contracted employer via SWPA for 1 year from the completion of contract unless using the agency to regain employment with them. If a contract with a client is terminated before its commencement, by either the contracted employer or SWPA, SWPA are not liable for any money to the artist, that would have been earnt during it's running.
Care of Acts and employed.
It is the duty of the contracted employer / booker / hirer to ensure the working conditions are safe and secure. It is not the responsibility of SWPA. Although we will do a preliminary check with each contracting company to ensure professional working conditions as best, we can. It is the responsibility of the client to fully read their employment contract AND NOT TO SIGN if they are unhappy with ANYTHING it holds. If this happens the client will contact both the contracted employer and SWPA to discuss any issues. Once a contract has been signed all details must be adhered to by both parties. 
Cancellations
If the ACT or BOOKER needs to cancel the performance the agency must be notified immediately and must be no later than 7 days before the performance date. 
If the BOOKER/VENUE fail to cancel within the time frame they will still be liable for the entire fee to the AGENCY/ARTIST/ACT.
The ACT must notify the VENUE and AGENCY no later than 14 days before the performance date to allow replacements to be found.
If the act fails to cancel within the time frame and/or does not show up to perform or work, they will be liable for a fee of 50% of their fee to the agency and 50%of their fee to the venue/booker, as compensation, unless there are exceptional circumstances (i.e. force majeure, grief of immediate family, motor accident, etc). In the event of the ACT being physically unable to perform at the last-minute due force majeure, grief of immediate family, motor accident etc the act MUST be active in helping to find a suitable and equal replacement alongside the agency.
The Venue must notify the Act and Agency no Later than 7 days before the performance date, if the VENUE fails to cancel in time, they will still be liable for full payment to the Act.
If the venue cancels within the time period allowed and then offers a replacement date which is then again cancelled, regardless of notice given, they will pay at least 70% of the fee to the artist unless the force Majure clause is relevant. 
In the event of a catastrophic incident (see force majeure clause) the venue will not be liable for any payment to the artist after the time allowed.

Acts 17 years and under will only be put forward for employment/booking after a child safety check has been made to ensure the safe and secure surroundings of the workplace and that DBS checked chaperones will be acquired by the contracting company.

SWPA Reputation.
SWPA and its reputation must remain profound. If there is a grievance between the CLIENT/ACT/BOOKER/VENUE and the agency, the client may not disclose this information with any 3rd party until matters are resolved. If this term is breached legal proceeding toward charges of slander may be enforced. 
Media consent
The Act/employed  consents to any media they send the agency for profiling, may also be used for advertisement and promotional means. If any media sent to us to use has any illegal basis (I.E copyrighted or inappropriate etc) then it will be removed from the site which may harm your ability to gain work Via SWPA.
Parental responsibilities.
Any persons 17 years old or under must have their profile material that is sent to the agency supervised and reviewed by a parent or legal guardian. This is to safeguard and ensure that all SWPA clients and members are protected and secure at all times.

FORCE MAJEURE
In the event of a catastrophic or natural disaster (earthquake, fire, great flood, terrorist attack, lockdown, government guidelines etc), all contracted details will become null and void and neither party will be obliged to fulfil their obligation
